1. Interpretation

In these Terms and Conditions, the following meanings apply unless the context requires otherwise:

• 1.1 "Legacara" refers to the business operating under that name, registered and operating from 8 Jalan Cangkat Stulang, 80300 Johor Bahru, Johor, Malaysia.
• 1.2 "Household" refers to the individual or group of individuals engaging Legacara's services for a residential dwelling.
• 1.3 "Session" refers to a scheduled in-home visit conducted by a Legacara facilitator as part of an agreed programme.
• 1.4 "Programme" refers to any of the three service offerings described on our website: the Single-Session Household Heritage Catalogue, the Four-Session Records Curation Programme, or the Annual Family Records and Heritage Programme.
• 1.5 "Deliverables" refers to the printed catalogue, labelled folder, family timeline, or other organisational outputs produced at the conclusion of a programme or session.

2. Nature of Services

• 2.1 Legacara provides household heritage cataloguing and records organisation services. All sessions are organisational and curatorial in character.
• 2.2 Legacara does not draft, prepare, witness, certify, interpret, translate, or process any document that has or is intended to have legal force. This includes — without limitation — wills, deeds, statutory declarations, powers of attorney, tenancy agreements, or identity documents.
• 2.3 Legacara does not provide legal, financial, tax, estate, medical, or any other form of professional advice. No statement made by a Legacara facilitator during a session constitutes professional counsel.
• 2.4 Where a household wishes to act on any organisational findings arising from a session — for instance, by engaging a solicitor, financial adviser, or government body — such decisions rest entirely with the household. Legacara does not direct, recommend, or facilitate such engagement.
• 2.5 Session deliverables — including printed catalogues and labelled folders — are for the household's own organisational use. They carry no legal standing and are not representations by Legacara as to the authenticity, completeness, or accuracy of any document or object examined.

3. Booking and Confirmation

• 3.1 An engagement is confirmed once Legacara has received a completed enquiry, agreed a session date and address in writing, and received payment in accordance with Clause 4.
• 3.2 Legacara will confirm programme bookings by email within two working days of receiving a completed enquiry.
• 3.3 Session dates and times are subject to mutual availability. Legacara operates Monday to Friday, 9:00 am to 6:00 pm, and Saturday, 10:00 am to 3:00 pm. Sessions are not conducted on Sundays or Malaysian public holidays.
• 3.4 Households are responsible for ensuring that an adult member of the household is present for the full duration of each session.

4. Fees and Payment

• 4.1 All fees are quoted and payable in Malaysian Ringgit (RM). Current programme fees are as set out on our website and in the confirmation communication.
• 4.2 For the Single-Session Household Heritage Catalogue (RM 590), full payment is due at the time of booking.
• 4.3 For the Four-Session Records Curation Programme (RM 1,920), a deposit of RM 640 is due at the time of booking, with the remaining RM 1,280 due prior to the third session.
• 4.4 For the Annual Family Records and Heritage Programme (RM 4,640), a deposit of RM 1,160 is due at the time of booking. The remaining balance is spread across three equal instalments of RM 1,160, due prior to each quarterly check-in session.
• 4.5 Payment may be made by bank transfer or such other method as Legacara advises. Fees quoted are inclusive of the preparation, facilitation, and standard printed deliverables described in the programme. Travel to addresses within Johor Bahru city and inner districts is included; travel to other areas may be subject to a supplementary charge, which will be communicated prior to booking confirmation.
• 4.6 Fees are subject to applicable Malaysian taxes. Where Sales and Services Tax (SST) or any successor tax applies to these services, it will be itemised separately in the invoice.

5. Rescheduling and Cancellations

• 5.1 Households may reschedule a session at no charge by giving at least 72 hours' written notice prior to the scheduled session time. Requests received with less than 72 hours' notice will be accommodated where possible; if Legacara is unable to reschedule within the same billing period, a rescheduling charge of RM 120 applies.
• 5.2 If a household cancels an engagement entirely:

• 5.3 If Legacara is unable to conduct a confirmed session due to circumstances within Legacara's reasonable control, Legacara will offer a rescheduled session at no additional cost or, if rescheduling is not practicable, a full refund of any amount paid attributable to that session.

6. Household Obligations

• 6.1 The household is responsible for ensuring the session space is reasonably clear and accessible, and that any materials intended for cataloguing are available at the time of the session.
• 6.2 The household confirms that all objects, documents, and photographs made available during a session are owned by, or within the lawful custody of, the household. Legacara assumes no responsibility for establishing ownership or provenance.
• 6.3 The household is responsible for retaining all original documents and objects. Legacara does not retain originals and does not take custody of any item during or after a session unless separately and explicitly agreed in writing.

7. Deliverables and Intellectual Property

• 7.1 Upon full payment of the applicable programme fee, the household receives ownership of all printed deliverables produced for their household — including the heritage catalogue, family timeline, and labelled folder.
• 7.2 The format, templates, and organisational systems used by Legacara in producing deliverables remain the intellectual property of Legacara. Households may use their own deliverables for personal and family purposes but may not reproduce Legacara's formats commercially.
• 7.3 Legacara may, with the household's prior written consent, refer to an engagement in general terms (e.g. in portfolio or testimonials). Legacara will not reproduce household names, photographs, or documents without explicit separate consent.

8. Liability

• 8.1 Legacara's liability for any claim arising from an engagement — whether in contract, negligence, or otherwise — is limited to the amount paid by the household for the specific session or programme to which the claim relates.
• 8.2 Legacara is not liable for any indirect or consequential loss arising from an engagement, including decisions made by the household following any session.
• 8.3 Nothing in these terms limits liability that cannot be limited under Malaysian law, including under the Consumer Protection Act 1999.
• 8.4 Because all sessions are organisational in character, Legacara is not responsible for any outcome that follows from the way the household chooses to act on catalogued or organised information after a session.

9. Confidentiality and Personal Data

• 9.1 Legacara treats all information encountered during sessions — including household contents, family names, and document descriptions — as confidential. Facilitators are required to maintain confidentiality as a condition of engagement.
• 9.2 Personal data collected in the course of an engagement is handled in accordance with our Privacy Policy and the Personal Data Protection Act 2010 (Malaysia).

10. Governing Law

• 10.1 These Terms and Conditions are governed by the laws of Malaysia, including the Contracts Act 1950 and the Consumer Protection Act 1999. Any dispute arising from or related to an engagement will be subject to the exclusive jurisdiction of the courts of Malaysia.
• 10.2 Legacara and the household agree to attempt to resolve any dispute informally in the first instance by written correspondence before initiating formal proceedings.

11. Changes to These Terms

Legacara may revise these Terms and Conditions from time to time. The revised version will be posted on this page with an updated "Last updated" date. For engagements already in progress at the time of any revision, the terms that applied at the time of booking will continue to govern that engagement unless both parties agree otherwise in writing.
